Dead Horse Sales & Rentals wants our customers to be confident in their purchases. We understand that there may be circumstances where an item needs to be returned. The following policy applies to purchases from Dead Horse Sales & Rentals, subject to any rights provided by applicable law.
General Returns
Most regularly stocked merchandise may be returned within 30 days of the original receipt date, provided that:
- The item is unused, undamaged, and in resalable condition.
- The item is returned with its original packaging, components, accessories, manuals, and other materials supplied with the product.
- Proof of purchase from Dead Horse Sales & Rentals is provided.
All returns are subject to inspection and approval by Dead Horse Sales & Rentals. Items that are used, damaged, incomplete, altered, or otherwise not in resalable condition may be refused.
The 30-day return period applies to discretionary returns and does not limit any rights or remedies that may apply to defective products under Manitoba law.
Powered Equipment
Certain powered equipment requires assembly, setup, lubrication, fueling, battery activation, warranty registration, pre-delivery inspection, or other preparation before being provided to the customer. Once this type of equipment has been prepared, registered, fueled, operated, or otherwise placed into service, it may not be eligible for return under our general 30-day return policy.
This may include, but is not limited to, lawn and garden equipment, chainsaws, trimmers, blowers, generators, pressure washers, snow removal equipment, and other powered or motorized equipment.
If powered equipment develops a defect, malfunction, or other performance issue, please contact Dead Horse Sales & Rentals. The product may first require inspection or diagnosis. Depending on the circumstances, the appropriate remedy may include repair, replacement, or refund in accordance with the applicable manufacturer warranty and applicable Manitoba law.
Manufacturer warranty terms, including exclusions for misuse, accidental damage, improper maintenance, unauthorized modification, or normal wear, may apply.
Special-Order Parts
Returns of special-order parts are accepted within 30 days of the original receipt date, subject to the following conditions:
- A 15% restocking fee will be applied to returned special-order parts.
- Parts must be unused, undamaged, and in their original packaging.
- All components and materials originally supplied with the part must be included.
- No returns will be accepted after 30 days from the original receipt date.
The restocking fee will not apply where the return is required because Dead Horse Sales & Rentals supplied an incorrect or defective item, except where otherwise permitted by applicable law.
Customers are encouraged to confirm model numbers, serial numbers, measurements, and other product information before ordering special-order parts.
Defective Products and Warranty Claims
A product that is defective is handled differently from a general return.
If you believe a product is defective, please contact Dead Horse Sales & Rentals as soon as reasonably possible. We may need to inspect, test, or diagnose the product before determining the appropriate course of action.
Products covered by a manufacturer’s warranty will be handled in accordance with the applicable warranty procedures and applicable law. A warranty claim does not necessarily entitle the customer to an immediate refund or replacement; repair may be the appropriate remedy depending on the product, warranty, and circumstances.
This policy does not exclude or limit any statutory warranty or other right that cannot legally be waived.
Returning Equipment or Merchandise
Unless otherwise arranged with Dead Horse Sales & Rentals, customers are responsible for returning merchandise to our location for inspection or processing.
Dead Horse Sales & Rentals does not provide general return shipping or courier service. For large equipment or items originally delivered by Dead Horse Sales & Rentals, please contact us before arranging a return.
Any pickup, transportation, or re-delivery associated with a discretionary return may be the customer’s responsibility. Where transportation or other costs are required to be covered as part of a valid warranty claim or under applicable law, those requirements will apply.
Original delivery charges are not refundable on discretionary returns unless the return resulted from an error by Dead Horse Sales & Rentals or unless otherwise required by law.
Refunds
Approved refunds will be processed after the returned product has been received and inspected.
Where possible, refunds will be issued using the original method of payment. Any applicable restocking fees or other permitted charges will be deducted from the refund.
Manitoba Consumer Rights
This return policy is intended to supplement, not replace, rights provided to customers under applicable consumer protection legislation.
Nothing in this policy limits any condition, warranty, right, or remedy that cannot legally be excluded or waived under The Consumer Protection Act of Manitoba or other applicable law.
